What Is the Statute of Limitations?

The statute of limitations is a legal mechanism by which you lose the right to exercise an action if you don't do so within a specific period. It is one of the most frequent causes of rights loss in Spain.

When Does the Deadline Start?

Generally from when you know or could have known about the event giving rise to the claim. This is important: it doesn't always coincide with the date of the incident.

How to Interrupt the Statute

  • Extrajudicial claim (burofax, certified letter)
  • Filing a lawsuit before the courts
  • Debt acknowledgment by the other party

Each interruption restarts the deadline from zero.
