Why does LO 1/2025 change everything?
Organic Law 1/2025, of 2 January, on measures for the efficiency of the Public Justice Service, establishes the obligation to attempt an adequate means of dispute resolution (ADR) before going to court in many civil and commercial cases. This will exponentially increase the demand for qualified mediators.
- Procedural requirement: prove ADR attempt before filing a lawsuit
- Scope: monetary claims, inheritance, family, homeowner associations
- Court referral: courts actively refer cases to mediation
