Claims Against Telecom Operators

Step 1: Complaint to customer service

All operators are required to have a customer service department. Always keep the reference number of your complaint.

Step 2: Telecommunications user service office

If in 1 month you receive no response or are not satisfied, you can claim before the State Secretariat for Telecommunications.

Step 3: Consumer arbitration board

Free alternative to resolve without going to court.

Banking Claims

Banks have a similar procedure but with specific bodies:

  1. Bank's customer service (mandatory)
  2. Customer ombudsman (if the bank has one)
  3. Bank of Spain (Claims Service): if they don't respond in 2 months
  4. Court action as a last resort

Frequent Banking Claim Causes

  • Undisclosed or abusive fees
  • Floor clauses (mortgages before 2013)
  • Mis-sold financial products
  • Revolving cards with usurious interest rates
  • Transfer errors or unauthorized charges
