Your rights with products that don't work: warranty periods, repair, replacement, and refund.

Legal Warranty in Spain

Since January 2022, the legal warranty for products in Spain is 3 years (previously 2). This applies to all new products purchased from a professional seller.

What Does the Warranty Cover?

The warranty covers any lack of conformity existing at the time of delivery:

  • The product doesn't work as advertised
  • It doesn't meet agreed characteristics
  • It's not suitable for normal use
  • It doesn't have expected quality

Your Options as a Consumer

When a product fails within warranty, you have the right to choose between:

  1. Repair of the product
  2. Replacement with a new one
  3. If neither is possible: price reduction or contract termination (refund)

Key Deadlines

  • 3 years legal warranty (new products)
  • 1 year for second-hand products (agreement between parties)
  • First 2 years: the defect is presumed to have existed at delivery (burden of proof reversal)

What Does the Warranty NOT Cover?

  • Damage caused by consumer misuse
  • Normal product wear and tear
  • Defects the consumer knew about when purchasing
