The Civil Cassation Appeal in Spain: Overview
The cassation appeal (recurso de casación) is the procedural mechanism enabling the Spanish Supreme Court (First Civil Chamber) to unify conflicting doctrine between Provincial Courts of Appeal (Audiencias Provinciales) and correct misapplications of substantive law. It is regulated in Articles 477-489 of the Civil Procedure Act (LEC).
It is not a third degree of jurisdiction. The Supreme Court does not review facts, findings of fact from lower courts are final. It only reviews how the law was applied.
When Is It Available?
Cassation appeals lie against Provincial Court of Appeal judgments ending second-instance proceedings when:
- The claim value exceeds €600,000
- The judgment raises casational interest (regardless of amount)
Casational Interest: The Key Concept
Three grounds (Art. 477.3 LEC):
a) Opposition to Supreme Court doctrine: The challenged judgment applies a rule contrary to how the TS has consistently interpreted it in two or more judgments.
b) Contradictory doctrine between Provincial Courts: Different Audiencias have interpreted the same rule opposite ways; the challenged judgment follows one of those interpretations.
c) Norm less than 5 years old with no TS precedent: Allows cassation for novel legal questions.
The Deadline: 20 Working Days
The appeal must be prepared (not fully filed, just announced) within 20 working days of the notification of the Audiencia's judgment (Art. 479 LEC). Once admitted for preparation, the full appeal must be filed within another 20 working days.
