Legal basis
Standard subsidy (Arts. 274-278 LGSS): For those who have exhausted the contributory benefit or did not reach the required 360 contribution days, provided they have family dependants or fall within one of the legal situations (≥45 years old, returned emigrant, released from prison, disability ≥33%).
Amount (Art. 278 LGSS): 80% of the monthly IPREM = €480/month in 2026. Exception: the over-52s subsidy is 100% IPREM = €600/month.
Income requirement (Art. 275 LGSS): Personal income must not exceed 75% of the minimum wage = €888/month. Where family dependants are present, the partner's income may be excluded from the calculation.
Mandatory registration (Art. 273.3 LGSS): Registration as a jobseeker at SEPE and signing the Activity Agreement are essential requirements for recognition and maintenance of the subsidy.
