Civil liability of sports clubs: player and spectator injuries in Spain
When a player is injured or a spectator is hurt at a sports event, who is liable? We analyse the organising club's liability, mandatory federation insurance (Law 39/2022) and contributory negligence.
Organising club liability
The organising club is liable for injuries suffered by participants and spectators during sporting events, under Art. 1902 Cc (tort liability) and Art. 1903 Cc (liability for employees and security services).
Mandatory federation insurance (Law 39/2022)
Law 39/2022 on Sport requires federations to take out collective insurance covering accidents for registered athletes. Insurance covers death, permanent disability and medical expenses.
Spectator injuries
Spectators have specific protection under Law 19/2007 against violence, racism, xenophobia and intolerance in sport and RD 203/2010 on sports facilities.
