FAQ about notary fees in Spain
Do Spanish notaries charge VAT?
No. Notaries are public officials in Spain and their fees are exempt from VAT under Art. 20.1.18 of the VAT Act (LIVA). Unlike property registrars (who charge 21% VAT), notaries do not apply VAT.
Can a notary charge more than the official tariff?
No. Notaries must charge exactly the tariff set by RD 1426/1989. The only permitted reduction is up to 10%. If you believe you have been overcharged, you can complain to the relevant Notarial College.
Who pays for the notary in a property sale?
By custom (not law), the seller pays for the original deed and the buyer pays for certified copies. In practice, it is agreed in the contract. For mortgages, since LCCI 2019, the bank pays the notary for the mortgage deed.
How much does a will cost at a notary?
An open will has a special fixed fee of ~€39. It is one of the cheapest notarial acts. With the certified copy and extra pages, the total cost is around €50-60. It does not depend on the testator's estate value.
