Court Costs: Complete Guide

Court costs are one of the most important ( and least understood ) aspects of civil litigation. A cost order can mean thousands of euros on top of the case result.

1. What They Include (Art. 241 LEC)

Lawyer fees, court agent tariffs, court fees, court-appointed expert fees, appeal deposits, copies and notarial deeds, edict publications. Not included: lawyer travel, internal photocopies, pre-litigation advice, party-appointed experts (unless expressly included).

2. Loser-Pays Rule (Art. 394 LEC)

3. The One-Third Rule (Art. 394.3 LEC)

Lawyer fees in cost assessment cannot exceed one third of the case amount. Exceptions: temerity, indeterminate amount, non-declaratory proceedings.

4. Cost Assessment (Art. 242-246 LEC)

Beneficiary files detailed bill with LAJ → LAJ verifies recoverability and cap → 10 days for condemned party to challenge → approved if unchallenged.

5. Challenging as Excessive (Art. 245 LEC)

Challenge within 10 days → LAJ requests Bar Association report → Bar may reduce → LAJ decides (may depart with reasons) → judicial review available.
