Types of Experts in Spanish Civil Proceedings

Party-Appointed Expert (Arts. 335-338 LEC)

Designated and paid by one party:

  • Free selection of the professional
  • Timing: submitted with the claim or defense, or announced for later submission (up to 5 days before the preliminary hearing)
  • Potential bias: courts weigh possible partiality
  • Cost: borne by the appointing party (recoverable if costs are awarded)

Court-Appointed Expert (Arts. 339-343 LEC)

Designated by the court from official lists:

  • Selection: by lottery from registered professionals
  • Enhanced impartiality: subject to recusal grounds similar to judges (Art. 343 LEC)
  • Advance payment: the requesting party must deposit estimated fees
  • Greater credibility: courts generally give more weight to court-appointed experts


Procedure

1. Submission of Expert Reports

Party expert reports are submitted with pleadings. Article 337 LEC allows announcing later submission if the report is not yet available.

2. Anticipatory Expert Evidence (Art. 293.2 LEC)

When there is a risk that the subject matter may disappear or change, expert evidence can be obtained in advance, useful for deteriorating property, evolving injuries, or at-risk documents.

3. Ratification at Trial (Art. 347 LEC)

The expert must appear at trial to confirm their report, clarify technical aspects, and answer questions from both parties and the court.

  • Review key points with the expert beforehand
  • Prepare clear questions reinforcing the conclusions
  • Anticipate opposing counsel's questions
  • Ensure the expert communicates clearly, avoiding unnecessary jargon
