De facto separation (separación de hecho) is when spouses cease cohabitation without obtaining a legal separation or divorce. Legally, they remain married in all civil effects. Many couples are unaware of the significant legal consequences.
Key legal effects
Community property (gananciales): the regime remains in force; assets acquired by either spouse remain community property, and debts may affect joint assets. The Supreme Court (STS 26 January 2006; STS 28 September 2018) has exceptionally accepted separation date as dissolution date for "notorious and prolonged" de facto separation, but this requires strong evidence. Safest route: notarial deed of de facto separation.
Inheritance: de facto separated spouses retain their reciprocal inheritance rights. The surviving spouse keeps the usufruct viudal right (Art. 834 CC) and intestate heir status (Art. 945 CC). If neither spouse wishes the other to inherit, an immediate will is essential.
Widowhood pensión: Social Security widowhood pensión continues for the surviving de facto separated spouse (STS 30 June 2014).
Maintenance and household expenses: maintenance for children (Arts. 93, 142 CC) and contribution to household expenses (Arts. 67, 1318 CC) persist regardless of separation.
Practical recommendations
- Execute a notarial deed regulating de facto separation (home use, asset division, maintenance).
- Make an urgent will if the other spouse should not inherit.
- Request provisional judicial measures for minor children.
- Change life insurance beneficiaries.
