# Holographic Will in Spain: Requirements, Notarisation and Challenges 2026
A holographic (ológrafo) will under Arts. 688–693 of Spain's Civil Code must be: (1) written entirely by the testator's own hand, (2) signed at the end, and (3) dated with full year, month and day. Any failure in these formal requirements renders the will void.
Available from age 14 (unlike notarial wills, which require full legal capacity), the holographic will must be notarised within 5 years of the testator's death (Art. 690.2 CC), a lapse period, not a limitation period.
Since the 2015 Law on Voluntary Jurisdiction, notarisation is done before a notary (not a judge): the notary verifies the signature against authenticated documents and, if needed, orders handwriting expert evidence.
Common grounds for challenge: non-handwritten passages, missing date component, or lack of mental capacity at execution.
Lexiel retrieves Supreme Court decisions on holographic will formalities, calculates the 5-year lapse deadline and drafts will challenges with verified citations.
