Preliminary ruling / Prejudicial question

Issue whose resolution determines the outcome of the main dispute and must be decided first. Criminal prejudiciality (Art. 40 LEC) suspends civil proceedings if criminal facts determine the civil controversy. A preliminary ruling before the CJEU (Art. 267 TFEU) may be raised by any court when the interpretation of EU law is decisive.
