Product liability

Strict liability of the manufacturer for damage caused by safety defects in their products. No fault required; it suffices to prove the defect, the damage and the causal link. Royal Legislative Decree 1/2007 (TRLGDCU) transposes Directive 85/374/EEC. New Directive 2024/2853 extends liability to digital products and AI.

Arts. 128-149 TRLGDCU / Dir. 2024/2853
