What is included in court costs?
Court costs include: attorney fees (per CGAE guidelines), court agent fees (RD 1373/2003), court taxes (Law 10/2012, only for legal entities since RDL 1/2015) and, where applicable, expert witness fees.
Are attorney fees regulated by law?
No. Attorney fees are freely set under Art. 44 of the General Statute of the Spanish Bar (EGAE). CGAE guidelines are merely indicative and used as reference for cost taxation.
Who pays court costs?
Spain follows the loser-pays principle (Art. 394 LEC): the party whose claims are entirely rejected is ordered to pay costs, unless the court finds serious doubts of fact or law.
