What is a workplace accident?
A workplace accident (AT) is defined in Art. 156.1 LGSS as "any bodily injury suffered by an employee with occasion or as a consequence of the work performed for another party". The definition is broad and includes in itinere accidents (on the way to or from work), work-related diseases not included in the occupational disease schedule, and recurrences of previous AT incidents.
Employer obligations in the first 24 hours
The employer must ensure immediate medical assistance through the Mutual Insurance Company (Mutua), file an accident report in the Delt@ system within 5 working days, and notify the Labour Authority within 24 hours for serious, very serious or fatal accidents.
Social security benefits for the injured worker
IT (temporary disability) benefits derived from AT are 75% of the AT contribution base from day 1, which is more generous than common contingency sick leave. The worker may also access permanent disability pensions (IPP/IPT/IPA) depending on the severity of sequelae.
Benefit surcharge: the key legal tool
Under Art. 164 LGSS, if the accident was caused by the employer's failure to implement safety measures, the INSS can impose a surcharge of 30-50% on all social security benefits. This surcharge is paid exclusively by the employer and cannot be insured or transferred. It is compatible with civil compensation claims.
Civil liability
Independently of social security benefits, the worker can claim civil compensation for damages (Art. 1101 or 1902 CC). Claims are typically valued using the traffic accident scale (Law 35/2015) as a reference. The statute of limitations is 1 year from the date the injured party could exercise the action (Art. 59.2 ET).
