Law 8/2021, of 2 June (Ley 8/2021), reforming civil and procedural legislation to support persons with disabilities in the exercise of their legal capacity, brought about a revolution in Spanish Civil Law. By aligning the legal framework with the UN Convention on the Rights of Persons with Disabilities (CRPD, 2006), it abolished judicial incapacitation and guardianship (tutela) for adults, replacing them with a system of graduated support measures centred on personal autonomy.
1. Fundamental Principles of the New System
From a substitution model to a support model: the previous paradigm (incapacitation + tutela as a substitute for individual will) was replaced by one that respects the will, wishes and preferences of the person with a disability, providing assistance only to the extent necessary.
Guiding principles (Art. 249 of the Código Civil [Civil Code]):
- Necessity: a support measure is only adopted where necessary
- Proportionality: the least restrictive measure compatible with the individual's situation
- Personalisation: tailored to the person's specific circumstances
- Temporality: subject to periodic review
- Respect for individual will: the support follows the express or presumed wishes of the person
2. Support Measures: Classification
2.1 Voluntary Measures (without judicial intervention)
Preventive powers of attorney (Art. 257 CC): the grantor may confer powers that remain in force or come into effect upon loss of capacity. These must be expressly set out in a notarial deed.
Self-appointed curatorship (autocuratela) (Art. 271 CC): the individual may themselves propose to the court who should act as their curator when the time comes, along with any instructions they consider appropriate.
Support agreements (Art. 255 CC): agreements formalised in a public deed (escritura pública) before a notary, by which the person with a disability designates one or more individuals to support them in the exercise of their legal capacity.
2.2 Judicial Measures
De facto guardianship (guarda de hecho) (Arts. 263–267 CC): where a person is already acting in practice to support someone with a disability, the reform confers full legal effect on their actions for ordinary matters.
Curatorship (curatela) (Arts. 268–294 CC): may take the form of:
- Assistive curatorship: the curator supplements the person's capacity; the individual acts on their own behalf whenever possible
- Representative curatorship (Art. 269 CC): only where the person cannot act independently; the curator acts on their behalf
Judicial defender (defensor judicial) (Art. 295 CC): for specific situations or conflicts of interest.
3. Judicial Proceedings
Standing to Apply for Curatorship (Art. 757 of the LEC [Law of Civil Procedure])
- The person with a disability themselves
- Their spouse or registered civil partner
- Descendants, ascendants or siblings
- The Ministerio Fiscal (Public Prosecutor's Office), acting on its own initiative or at the request of the interested party
Procedure for Determining Support Measures (Arts. 756 et seq. LEC)
Jurisdiction: the Tribunal de Instancia (Court of First Instance) in the place where the person with a disability is domiciled.
Judicial hearing (Art. 759 LEC): the judge must personally interview the person with a disability before reaching a decisión. Failure to do so constitutes grounds for nullity.
Expert medico-forensic report: an assessment of the person's functional and cognitive situation. The judge is not bound by its conclusions.
Ruling (Art. 760 LEC): the judgment must identify the activities for which support is required, designate a curator with specific functions, establish supervision arrangements, and set a review period (máximum 3 years).
Appointment of the Curator
Statutory order of preference (Art. 275 CC):
- The person proposed by the individual themselves
- The spouse or civil partner who lives with them
- Children or descendants
- Ascendants
- Siblings
Acts Requiring Judicial Authorisation (Art. 287 CC)
In representative curatorship:
- Waiver of rights
- Disposal of real estate or commercial establishments
- Acceptance of inheritances without the benefit of inventory
- Contracts with a duration exceeding 6 years
4. Review of Measures
Review is mandatory within the timeframes set out in the ruling (máximum 3 years). It may also be triggered:
- At the request of any person with standing, when circumstances change
- On the initiative of the Ministerio Fiscal
- At the request of the person with a disability themselves
5. Adaptation of Pre-Existing Situations
Pre-existing guardianships (tutelas) (Transitional Provisión 5): these are automatically deemed converted into curatorships (curatelas). No judicial ruling is required to change the designation, but adjustments must be made at the first scheduled review.
Pre-existing incapacitations: any person with standing may apply for a review of the measure in accordance with the new regulatory framework.
6. Practical Considerations
Common errors following Law 8/2021:
- Applying for full representative curatorship when assistive curatorship would suffice
- Failing to propose graduated support measures
- Omitting the individual's own proposal regarding their curator
- Failing to include a specific support plan in the claim
