Scope of the claim

Legal notice: Indicative calculation based on simple interest on average capital. Does not include the actual amortisation schedule or compound interest. For a court claim, prepare the full schedule. The ECJT (C-154/15, 21/12/2016) declared full retroactivity regardless of STS 9/5/2013.

Legal basis: Art. 6.1 Directive 93/13/EEC on unfair terms. The nullity action is imprescriptible; the restitution claim expires 5 years from nullity declaration (STS 5/10/2021, 1st Chamber). Legal rate 2026: 3.25% (LPGE 2025 extended, same as 2025).
