The General Process Code: Colombia's New Procedural Standard

Since its full entry into force in 2016, the General Process Code (Law 1564 of 2012) transformed the Colombian civil procedural landscape. The main innovation: orality as the governing principle. Civil trials are no longer conducted exclusively in writing, hearings are held orally before the judge.

Types of Proceedings Under the CGP

The CGP classifies civil proceedings into three main groups:

Declaratory Proceedings

  • Verbal Process (Arts. 368-390 CGP): the ordinary process for lower-value disputes and special family proceedings. Initial hearing + instruction and judgment hearing.
  • Summary Verbal Process (Arts. 391-396 CGP): for minimum-value matters. A single hearing.
  • Company Liquidation Process: judicial dissolution and liquidation.

Executive Proceedings

When the creditor already has an executive title (promissory note, bill of exchange, final judgment). The singular executive process seeks attachment and sale of the debtor's assets.

Critical deadlines include:

  • Payment order: the defendant has 10 business days to raise defenses (Art. 442 CGP)
  • Transfer of defenses to the plaintiff: 5 business days to respond

Family Proceedings

The CGP unified under a single code the proceedings for divorce, marriage annulment, custody, alimony, and paternity. Pre-judicial conciliation is a procedural requirement in family matters.

Deadlines in the CGP are more compressed than under the old CPC:

The CSJ and Colombian Case Law

The Supreme Court of Justice (CSJ), Civil Cassation Chamber, is the primary source of probable doctrine in civil matters. Its case law is not formally binding as in Mexico, but carries decisive weight in judicial practice.

The Constitutional Court issues abstract constitutionality control judgments and reviews tutelas, which are binding erga omnes.

  1. Instruction and judgment hearing: examination of testimonial, expert, and documentary evidence. The lawyer must have prepared examinations and cross-examinations.

  1. Closing arguments: oral summary of proven facts and legal grounds.
