Law 7/2022: circular economy in Spain

Law 7/2022 on waste and contaminated soil for a circular economy modernises the waste regime, transposes Directives 2018/851, 2018/849 and 2019/904, and reinforces extended producer responsibility (EPR).

Key obligations for producers

  • EPR: bear costs of collection, treatment and communication for products at end of life
  • Ecodesign: design products for greater durability and recyclability
  • Registration: mandatory entry in the MITERD Producers Register (RPP)

Obligations for waste managers

  • Regional authority authorisation for each management operation
  • Written contract with producers/holders
  • Annual report with quantities managed

Sanctioning regime

Very serious infringements: up to €2M or 2% of turnover. Serious: up to €300K. Minor: up to €6K.
