Main phases:

  1. Summary claim or standardized form
  2. Summons to oral hearing (within the following 10 days)
  3. Oral hearing: arguments, evidence proposals and practice
  4. Judgment (10 days from hearing)

The key to verbal proceedings is hearing preparation: there is no prior written answer phase, so the defense is prepared solely for the oral act.

Monitory Proceedings (Art. 812 LEC)

For claiming liquid monetary debts up to €250,000, with documentary evidence of the credit. It is the most efficient procedure for business debts or professional service fees.

Phases:

  1. Initial petition with supporting documentation
  2. Judicial payment order (within 20 days)
  3. Payment → Dismissal | Opposition → Ordinary/verbal proceedings | No response → Direct enforcement
