The Legal Aid Act (Law 1/1996, LAJG) grants the right to duty solicitor assistance and other procedural benefits to those lacking sufficient economic resources. It is a direct expression of Art. 119 of the Spanish Constitution and Art. 24 CE (right to effective judicial protection).

Persons whose family unit income does not exceed: twice the IPREM (€1,200/month in 2026) if applying alone; 2.5× IPREM with 2-4 family members; 3× IPREM for larger families or members with ≥33% disability. Victims of gender violence, domestic violence, terrorism, trafficking and minors in certain proceedings are automatically entitled regardless of income (Arts. 2 bis and 5 LAJG).

How to apply

Submit the official form to the Legal Aid Commission at the local Bar Association. Required documents: ID, census registration certificate, income documentation (tax return or AEAT certificate, payslips, benefit certificates) and property declarations. The Bar designates a provisional duty solicitor within 15 days. The Commission resolves within 30 days; silence is deemed acceptance.
