Do I have to pay even if I lose the case?

It depends on the agreement. Under standard billing fees are due regardless of outcome. Under contingency the lawyer only charges on a favorable result.

Am I entitled to legal aid?

Yes, if your income does not exceed 2 times the IPREM (~€16,000/year gross in 2026 for a single person). Granted by the Legal Aid Commission of your provincial Bar Association.

Is a court representative (procurador) mandatory?

Yes in most judicial proceedings. Their fees are regulated (RD 1373/2003) and range from ~€300 for small matters to several thousand for high-value cases.
